Those who serve in the military (the Army, Navy, Marine Corps, and Coast Guard) are subject to the Uniform Code of Military Justice and are to be tried via court martial.

There are three different levels of courts-martial. As far as military courts are concerned, while a summary court-martial is for minor offenses, the general court martial is the most serious. Made up of at least five officers, it hears the military equivalent of civilian felonies due to the nature of the crimes presented as well as the potential severity of the punishments. Punishments by the general court martial may include dishonorable discharge, confinement, and in some cases, even death.

What Types of Cases Does a General Court-Martial Hear?

A General Court-Marital hears a variety of serious cases. Such cases include:

  • Assault and violent crimes
  • Child abuse – both physical and sexual
  • Connection to child pornography
  • High value arson
  • High value larceny
  • Murder and some degrees of homicide
  • Sexual assault
  • Rape
