United States Court of Appeals for the Armed Forces Attorney

The United States Court of Appeals for the Armed Forces is the highest military appellate court.  It has jurisdiction over matters involving military members of all branches and issues arising all over the world.  The court is comprised of five judges that are appointed by the President of the United States for 15 year terms and sits in Washington, D.C.  

This court hears appeals involving military legal issues under the Uniform Code of Military Justice and other laws.  These can be matters of factual, legal or procedural significance under Constitutional law, criminal law, evidence law, ethics and other areas.  It is important to note that issues heard by the United States Court of Appeals for the Armed Forces must have been heard by the lower appellate court.  Appeals from this court are appealed to the United States Supreme Court.  But, this court usually has the final say in these matters as only a small number of cases make it to the country’s highest court for review.

The United States Court of Appeals for the Armed Forces deals with broader military policy issues.  They are not obligated to review a case and have freedom to pick and choose which cases they would like to hear.  As such, in order for a case to be reviewed, it usually must involve a military legal issue that is currently active or controversial.  It is an art to know and stay abreast of which issues the court is currently interested in hearing.  These issues must also be clearly laid out in the Petition for Appeal in a way that grabs the courts attention.  Our court martial attorneys are proficient in seeking out and understanding the issues the court is interested in and use this to the advantage of our clients.  In our appellate practice, our attorneys are skilled in reviewing the lower court’s rulings, identifying the incorrect findings of fact or law and relating them to the issues in which the court is currently interested.
