What is the General Court-Martial?

Those who serve in the military (the Army, Navy, Marine Corps, and Coast Guard) are subject to the Uniform Code of Military Justice and are to be tried via court martial.

There are three different levels of courts-martial. As far as military courts are concerned, while a summary court-martial is for minor offenses, the general court martial is the most serious. Made up of at least five officers, it hears the military equivalent of civilian felonies due to the nature of the crimes presented as well as the potential severity of the punishments. Punishments by the general court martial may include dishonorable discharge, confinement, and in some cases, even death.

What Types of Cases Does a General Court-Martial Hear?

A General Court-Marital hears a variety of serious cases. Such cases include:

  • Assault and violent crimes
  • Child abuse – both physical and sexual
  • Connection to child pornography
  • High value arson
  • High value larceny
  • Murder and some degrees of homicide
  • Sexual assault
  • Rape

What is the Purpose of a General Court-Martial?

Military law works to maintain order and discipline in the armed forces, and to promote justice. Its purpose is “to promote efficiency and effectiveness in the military establishment, and thereby to strengthen the national security of the United States.”

If you or a loved one is facing a general court-martial in Denver, Colorado, it is important that you consult with an attorney who not only understands martial law and the military, but also has a deep understanding of criminal law, various charges of which you may be accused, and potential consequences should you be found guilty.
